Terms of Service

Effective date: August 2, 2026

These Terms of Service (“Terms”) are a legal agreement between you and Lakes Global LLC (“Lakes Global,” “we,” “us,” or “our”), doing business as the City of Loon Harbor. By accessing or using the City of Loon Harbor application, website, and related services (collectively, the “Service”), you agree to these Terms. If you do not agree, do not use the Service.

1. Acceptance of these Terms

By accessing or using the Service, you agree to be bound by these Terms and our referenced policies. If you are using the Service on behalf of a company or other entity, you represent that you have authority to bind that entity, and “you” refers to that entity.

2. The Service

City of Loon Harbor is a fictional civic-life simulation. Residents create an account, receive a citizen file, and interact with city systems such as housing, business licensing, procurement (RFPs), schooling, household records, and optional paid subscriptions. The town, its council, districts, and characters are fictional and intended for entertainment and illustration only.

3. Eligibility and authority

You must be at least the age of majority in your jurisdiction (or at least 13 with parental consent where permitted) to use any part of the Service that requires payment. You may not use the Service if you are barred from doing so under applicable law. If you are accepting these Terms on behalf of an organization, you represent that you are authorized to bind that organization.

4. Accounts and security

You are responsible for all activity on your account and for maintaining the confidentiality of your login credentials. You agree to provide accurate information and keep it up to date. We may suspend or terminate accounts to protect the Service or if we reasonably believe the account is being used in violation of these Terms, poses a security or fraud risk, or is repeatedly or seriously violating our policies.

5. Subscriptions, payments, and billing

5.1 Subscription plans

The Service may offer optional paid subscription plans, such as the Treasury Grant and Private Security Detail, that unlock additional features. Subscription features, pricing, and availability may change over time.

5.2 Paddle Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. By making a purchase, you also agree to Paddle’s Buyer Terms.

5.3 Payment processing

Paddle processes payments on our behalf. We do not store complete payment card numbers on our systems; card data is handled by Paddle in accordance with its policies.

5.4 Auto-renewal

Unless you cancel, subscriptions automatically renew at the end of each billing period. You authorize us and Paddle to charge the then-current subscription fee, plus applicable taxes, using your selected payment method.

5.5 Trials, promotions, and discounts

We may offer free trials or promotional pricing. Unless stated otherwise, trials convert to paid subscriptions at the end of the trial period, and you will be charged unless you cancel before the trial ends.

5.6 Taxes

Prices may not include taxes. You are responsible for applicable taxes, and Paddle may collect them where required.

5.7 Cancellations

You can cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period unless otherwise required by law.

5.8 Refunds

Refunds are handled according to our Refund Policy, which offers a 30-day money-back guarantee processed by Paddle.

5.9 Failed payments

If a payment fails or your account becomes past due, we may suspend paid features until payment is received.

6. License and acceptable use

6.1 License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business use.

6.2 Prohibited conduct

You agree not to:

  • use the Service for any unlawful purpose or in violation of any applicable law;
  • commit fraud, spam, or impersonate any person or entity;
  • infringe or misappropriate any intellectual property or other rights;
  • interfere with or disrupt the Service, including by introducing malware, probing, scraping, or attempting unauthorized access;
  • use automated means to access the Service except as expressly permitted by us;
  • circumvent usage limits or access restrictions;
  • use the Service to transmit unlawful, harmful, threatening, or abusive content.

7. User content

If you upload, submit, or otherwise make content available through the Service (“User Content"), you retain ownership of your User Content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for formatting or processing), and display your User Content only as necessary to operate, maintain, and improve the Service. You are responsible for your User Content and represent that you have all rights necessary to provide it and grant the above license. We may remove or restrict access to User Content if we reasonably believe it violates these Terms, applicable law, or the rights of others.

8. Intellectual property

The Service, including its software, design, branding, and content (excluding User Content), is owned by Lakes Global LLC and its licensors and is protected by intellectual property laws. No rights are granted except as expressly stated in these Terms.

9. Third-party services and links

The Service may integrate with or link to third-party services. We are not responsible for third-party services, content, or policies. Your use of third-party services is at your own risk and may be governed by separate terms.

10. Privacy

Our collection and use of personal information is described in our Privacy Policy. By using the Service, you consent to our data practices as described there.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components, or that any content or results provided through the Service will be accurate or reliable.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: IN NO EVENT WILL LAKES GLOBAL LLC, ITS AFFILIATES, EMPLOYEES, DIRECTORS, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE. Our total liability for all claims arising out of or related to the Service will not exceed the greater of (A) the amount you paid to us for the Service in the 12 months before the event giving rise to the claim, or (B) $100. Some jurisdictions do not allow certain limitations; in that case, liability will be limited to the maximum extent permitted. Nothing in these Terms limits liability for fraud, death, or personal injury where required by law.

13. Indemnification

You agree to defend, indemnify, and hold harmless Lakes Global LLC and its affiliates, officers, directors, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising from or related to your use of the Service, your User Content, your violation of these Terms, or your violation of any rights of another.

14. Termination and suspension

You may stop using the Service at any time. We may suspend or terminate your access at any time for material breach, non-payment, security or fraud risk, repeated or serious policy violations, or if required by law. Upon termination, your right to use the Service stops. Sections that by their nature should survive will survive, including payment obligations, disclaimers, limitation of liability, indemnification, and dispute provisions.

15. Changes to the Service or Terms

We may update the Service and these Terms from time to time. If changes are material, we will provide notice as required by law. Your continued use of the Service after the effective date of updated Terms constitutes acceptance.

16. Governing law and venue

These Terms are governed by the laws of [Your State/Country], without regard to conflict-of-laws principles. Any dispute that is not subject to arbitration will be brought exclusively in the courts located in [Your County/State], and you consent to personal jurisdiction there.

17. Dispute resolution

If a dispute arises, you agree to first contact us and attempt to resolve it informally. If the dispute is not resolved informally, it will be resolved through binding arbitration on an individual basis to the extent permitted by law, and you waive any right to participate in a class action to that extent. Arbitration clauses are not enforceable in some jurisdictions; where prohibited, disputes will be resolved in the courts described in Section 16.

18. Force majeure

We will not be liable for any failure or delay in performance due to causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, or utility failures.

20. Miscellaneous

Entire Agreement: These Terms and any referenced policies form the entire agreement between you and Lakes Global LLC regarding the Service.

Severability: If any provision is found unenforceable, the remaining provisions remain in effect.

No Waiver: Failure to enforce a provision is not a waiver.

Assignment: You may not assign these Terms without our consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets.
